Business Interruption Wordings and Claims: Legal Review

There remains significant uncertainty around the extent of cover under some Business Interruption wordings, Denial of Access, Notifiable Disease, and Public Authority extensions. Some insurers, faced with thousands of potential claims, have been reluctant to fully state their position or have signalled that no cover attaches with respect to COVID-19 − ultimately many of these cases could be decided in the courts. In response, Marsh Networks – on behalf of all its members’ clients – has engaged the services of an external law firm to review policy wordings across 92 insurers and more than 1,000 products.
